Dispute Resolution and Arbitration; Class Action Waiver

Please read this carefully. It affects your rights.

Most concerns can be resolved by contacting contactsminc@pm.me. If a dispute cannot be resolved, you and S.M. Inc agree that all Disputes shall be resolved by binding arbitration. This constitutes a waiver of your right to a jury trial.


Pre-Arbitration Claim Resolution:

You must first mail a written notification of your claim to contactsminc@pm.me. If S.M. Inc does not resolve the dispute within 45 days, you may pursue arbitration.


Location of Arbitration:

You or S.M. Inc may initiate arbitration in the State of Washington or the federal judicial district that includes your billing address. In the event that you select your own federal judicial district, S.M. Inc may transfer the arbitration to Washington State provided we agree to pay additional fees incurred by the transfer.


Class Action Waiver: THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.

General


S.M. Inc prefers to advise you of non-compliance and recommend corrective action; however, violations may result in immediate termination of access. The Federal Arbitration Act, Washington State law, and applicable U.S. federal law will govern these Terms. Except for disputes subject to arbitration, any legal actions relating to these Terms or the Site will be heard in the courts located in Snohomish County, Washington.


These Terms are the entire agreement between you and S.M. Inc and supersede all prior negotiations regarding SMLocalMarketing.com and the associated Services.


Messaging Terms & Conditions

  1. General: By opting into messages, you agree to receive recurring automated marketing and informational texts from S.M. Inc.
  2. Cancellation: Text “STOP” at any time to unsubscribe.
  3. Support: Text “HELP” or email contactsminc@pm.me.
  4. Transfer of Number: You must notify us if you change or transfer your mobile number.
